If there is anyone out there who still doubts that America is a place where all things are possible; who still wonders if the dream of our founders is alive in our time; who still questions the power of our democracy, tonight is your answer.


It’s the answer told by lines that stretched around schools and churches in numbers this nation has never seen; by people who waited three hours and four hours, many for the very first time in their lives, because they believed that this time must be different; that their voice could be that difference.


It’s the answer spoken by young and old, rich and poor, Democrat and Republican, black, white, Latino, Asian, Native American, gay, straight, disabled and not disabled – Americans who sent a message to the world that we have never been a collection of Red States and Blue States: we are, and always will be, the United States of America.


It’s the answer that led those who have been told for so long by so many to be cynical, and fearful, and doubtful of what we can achieve to put their hands on the arc of history and bend it once more toward the hope of a better day.


It’s been a long time coming, but tonight, because of what we did on this day, in this election, at this defining moment, change has come to America.


I just received a very gracious call from Senator McCain. He fought long and hard in this campaign, and he’s fought even longer and harder for the country he loves. He has endured sacrifices for America that most of us cannot begin to imagine, and we are better off for the service rendered by this brave and selfless leader. I congratulate him and Governor Palin for all they have achieved, and I look forward to working with them to renew this nation’s promise in the months ahead.


I want to thank my partner in this journey, a man who campaigned from his heart and spoke for the men and women he grew up with on the streets of Scranton and rode with on that train home to Delaware, the Vice President-elect of the United States, Joe Biden.


I would not be standing here tonight without the unyielding support of my best friend for the last sixteen years, the rock of our family and the love of my life, our nation’s next First Lady, Michelle Obama. Sasha and Malia, I love you both so much, and you have earned the new puppy that’s coming with us to the White House.


And while she’s no longer with us, I know my grandmother is watching, along with the family that made me who I am. I miss them tonight, and know that my debt to them is beyond measure.



To my campaign manager David Plouffe, my chief strategist David Axelrod, and the best campaign team ever assembled in the history of politics – you made this happen, and I am forever grateful for what you’ve sacrificed to get it done.


But above all, I will never forget who this victory truly belongs to – it belongs to you.


I was never the likeliest candidate for this office. We didn’t start with much money or many endorsements. Our campaign was not hatched in the halls of Washington – it began in the backyards of Des Moines and the living rooms of Concord and the front porches of Charleston.


It was built by working men and women who dug into what little savings they had to give five dollars and ten dollars and twenty dollars to this cause.


It grew strength from the young people who rejected the myth of their generation’s apathy; who left their homes and their families for jobs that offered little pay and less sleep; from the not-so-young people who braved the bitter cold and scorching heat to knock on the doors of perfect strangers; from the millions of Americans who volunteered, and organized, and proved that more than two centuries later, a government of the people, by the people and for the people has not perished from this Earth. This is your victory.



I know you didn’t do this just to win an election and I know you didn’t do it for me. You did it because you understand the enormity of the task that lies ahead. For even as we celebrate tonight, we know the challenges that tomorrow will bring are the greatest of our lifetime – two wars, a planet in peril, the worst financial crisis in a century. Even as we stand here tonight, we know there are brave Americans waking up in the deserts of Iraq and the mountains of Afghanistan to risk their lives for us. There are mothers and fathers who will lie awake after their children fall asleep and wonder how they’ll make the mortgage, or pay their doctor’s bills, or save enough for college.


There is new energy to harness and new jobs to be created; new schools to build and threats to meet and alliances to repair.


The road ahead will be long. Our climb will be steep. We may not get there in one year or even one term, but America – I have never been more hopeful than I am tonight that we will get there. I promise you – we as a people will get there.


There will be setbacks and false starts. There are many who won’t agree with every decision or policy I make as President, and we know that government can’t solve every problem. But I will always be honest with you about the challenges we face.

I will listen to you, especially when we disagree. And above all, I will ask you join in the work of remaking this nation the only way it’s been done in America for two-hundred and twenty-one years – block by block, brick by brick, calloused hand by calloused hand.


What began twenty-one months ago in the depths of winter must not end on this autumn night. This victory alone is not the change we seek – it is only the chance for us to make that change. And that cannot happen if we go back to the way things were. It cannot happen without you.
So let us summon a new spirit of patriotism; of service and responsibility where each of us resolves to pitch in and work harder and look after not only ourselves, but each other.

Let us remember that if this financial crisis taught us anything, it’s that we cannot have a thriving Wall Street while Main Street suffers – in this country, we rise or fall as one nation; as one people.


Let us resist the temptation to fall back on the same partisanship and pettiness and immaturity that has poisoned our politics for so long. Let us remember that it was a man from this state who first carried the banner of the Republican Party to the White House – a party founded on the values of self-reliance, individual liberty, and national unity. Those are values we all share, and while the Democratic Party has won a great victory tonight, we do so with a measure of humility and determination to heal the divides that have held back our progress.


As Lincoln said to a nation far more divided than ours, “We are not enemies, but friends…though passion may have strained it must not break our bonds of affection.” And to those Americans whose support I have yet to earn – I may not have won your vote, but I hear your voices, I need your help, and I will be your President too.


And to all those watching tonight from beyond our shores, from parliaments and palaces to those who are huddled around radios in the forgotten corners of our world – our stories are singular, but our destiny is shared, and a new dawn of American leadership is at hand. To those who would tear this world down – we will defeat you. To those who seek peace and security – we support you. And to all those who have wondered if America’s beacon still burns as bright – tonight we proved once more that the true strength of our nation comes not from our the might of our arms or the scale of our wealth, but from the enduring power of our ideals: democracy, liberty, opportunity, and unyielding hope.


For that is the true genius of America – that America can change. Our union can be perfected. And what we have already achieved gives us hope for what we can and must achieve tomorrow.
This election had many firsts and many stories that will be told for generations. But one that’s on my mind tonight is about a woman who cast her ballot in Atlanta. She’s a lot like the millions of others who stood in line to make their voice heard in this election except for one thing – Ann Nixon Cooper is 106 years old.

She was born just a generation past slavery; a time when there were no cars on the road or planes in the sky; when someone like her couldn’t vote for two reasons – because she was a woman and because of the color of her skin.


And tonight, I think about all that she’s seen throughout her century in America – the heartache and the hope; the struggle and the progress; the times we were told that we can’t, and the people who pressed on with that American creed: Yes we can.


At a time when women’s voices were silenced and their hopes dismissed, she lived to see them stand up and speak out and reach for the ballot. Yes we can.


When there was despair in the dust bowl and depression across the land, she saw a nation conquer fear itself with a New Deal, new jobs and a new sense of common purpose. Yes we can.
When the bombs fell on our harbor and tyranny threatened the world, she was there to witness a generation rise to greatness and a democracy was saved. Yes we can.


She was there for the buses in Montgomery, the hoses in Birmingham, a bridge in Selma, and a preacher from Atlanta who told a people that “We Shall Overcome.” Yes we can.


A man touched down on the moon, a wall came down in Berlin, a world was connected by our own science and imagination. And this year, in this election, she touched her finger to a screen, and cast her vote, because after 106 years in America, through the best of times and the darkest of hours, she knows how America can change. Yes we can.


America, we have come so far. We have seen so much. But there is so much more to do. So tonight, let us ask ourselves – if our children should live to see the next century; if my daughters should be so lucky to live as long as Ann Nixon Cooper, what change will they see? What progress will we have made?


This is our chance to answer that call. This is our moment. This is our time – to put our people back to work and open doors of opportunity for our kids; to restore prosperity and promote the cause of peace; to reclaim the American Dream and reaffirm that fundamental truth – that out of many, we are one; that while we breathe, we hope, and where we are met with cynicism, and doubt, and those who tell us that we can’t, we will respond with that timeless creed that sums up the spirit of a people:


Yes We Can. Thank you, God bless you, and may God Bless the United States of America.

Malaysia Is Between WHO STINKS Less

Delmonico’s, near Wall Street, is a bit like The Restaurant at the End of the Universe in Douglas Adam’s book of the same name. Get a window seat there right now and almost quite literally you will be able to watch the universe end while you await your steak. But if you fancy tamer fare then try a restaurant in Kuala Lumpur. Get a window seat there now and you will be entertained by the end of the Malaysian Government.
 
The death throes of prime minister Abdullah Badawi’s government are fascinating. Like someone who cannot swim but who has just been thrown overboard, Abdullah is grabbing at anything to try to save himself. So far he’s gone for that third world tool of choice: you jail dissenters, which is a pity because these days Malaysians are more sophisticated than that.
 
In the last few weeks, an opposition politician has been arrested under Malaysia’s outdated Internal Security Act (ISA) which allows for detention without trial, legal counsel, the right to defend oneself in court, or the presumption of innocence until proven guilty.
 
The politician, who is ethnically Chinese, was detained for inciting religious and racial tension. Apparently she complained about excessive noise emanating from a mosque in her constituency. That is not a race or a religious issue. It is a planning issue – the sort of thing that MPs are supposed to bring up.
 
Similarly, a journalist was arrested under the ISA for accurately reporting the racist remarks of a member of the ruling party. Essentially, she was arrested for being a good journalist, something in short supply in Malaysia. The party official was not arrested, although he was suspended.
 
A blogger was arrested for apparently exhibiting the Malaysian flag on his website upside down. I kid you not. It’s hard to imagine a modern government anywhere being that petty particularly in a world in which serious problems are not in short supply. And if there’s one thing that doesn’t matter, it’s flags. Trample on them, burn them – the world would be a better place without them.
 
But perhaps Abdullah’s saddest mis-step has been the arrest of Raja Petra Kamarudin, who runs the hugely popular Malaysia Today website which routinely exposes wrongdoers in public life and provided a forum for robust political debate otherwise denied to Malaysians.
 
On September 23, Syed Hamid Albar, the Home Affairs Minister signed the order for Raja Petra’s detention without trial for two years. The order can be renewed indefinitely. Ostensibly, Raja Petra, a Muslim, was arrested for posting blogs that belittled Islam. The reality of course is that Raja Petra had belittled the government. No longer can he post blogs that challenge the government and blow the whistle on corruption and other wrong doings on the part of government officials. 
 
Raja Petra appeared in court on Monday on a separate sedition charge. He was handcuffed which is apt:  you can’t write if you’re handcuffed.
 
Raja Petra knew that he could well be arrested and yet he continued. This sort of selflessness is all too rare in Malaysia. In years to come, streets will be named after him and postage stamps bearing his image will be issued. No-one will remember Syed Hamid Albar, other than those he has jailed.
 
Even Mahathir Mohamed, Malaysia’s previous prime minister, who incidentally will be speaking at a seminar at Melbourne University this coming Saturday, has criticised the recent ISA arrests as unnecessary and excessive.
 
Perhaps such arrests are warranted in a country dangerously on the edge of racial and religious meltdown. But Malaysia is not. Malaysians are peace-loving and very, very tolerant. They have proven this time and again. When other countries have blown up into rioting and communal tension, modern Malaysia has not. The most obvious example was during the 1996-97 economic crisis when all the region’s economies verged on collapse. Indonesia erupted with ethnic killing, looting and rape, largely directed against that country’s small but wealthy ethnic Chinese community. Malaysians on the other hand pulled together. There was no finger pointing at least not along race lines. Malaysia did not even go close to communal unrest.
 
The truth is that the Malaysian government is the biggest source of ethnic and religious tension in Malaysia. It has an interest in constantly harping on about race, using imagined communal tensions as an excuse for its use of the ISA, to control the media and above all, to head off threats to its own power.  The race issue is manipulated not to protect Malaysians from each other but to protect the government from opposition. 
 
But the cracks are showing. Malaysia has never had a government this unpopular. Abdullah has said that he will leave office early but he refuses to resign. Najib Tun Razak, his deputy, is congenial enough but he is no leader. And then there’s Anwar Ibrahim.
 
Anwar is offering himself up as head of an alternative government but he has shown himself to be appallingly politically incompetent. He announced that the government would fall on September 16 because by then he would have the support of enough government MPs who he said were prepared to leave the government and join the opposition. When that day came, nothing happened. The golden rule of politics is that you don’t telegraph your punches; you simply punch. Anwar has a lot of baggage too, and so at a time when Malaysia needs clever leadership more than ever, the sad choice for Malaysians is between who stinks less.

Abdullah Badawi said yesterday he would step down as Malaysian prime minister in March, clearing the way for Najib Razak, his deputy, to succeed him.

Mr Abdullah, who came to power five years ago, sought to introduce economic reforms and anti-corruption measures, but was blocked by resistance within his own party, the United Malays National Organisation.


He will hand over power to Mr Najib when Umno holds party elections in March to select a new leader.

The 95 Brave Heros of The People

Friends,

Everyone said the bill would pass. The masters of the universe were already making celebratory dinner reservations at Manhattan's finest restaurants. Personal shoppers in Dallas and Atlanta were dispatched to do the early Christmas gifting. Mad Men of Chicago and Miami were popping corks and toasting each other long before the morning latte run.

But what they didn't know was that hundreds of thousands of Americans woke up yesterday morning and decided it was time for revolt. The politicians never saw it coming. Millions of phone calls and emails hit Congress so hard it was as if Marshall Dillon, Elliot Ness and Dog the Bounty Hunter had descended on D.C. to stop the looting and arrest the thieves.

The Corporate Crime of the Century was halted by a vote of 228 to 205. It was rare and historic; no one could remember a time when a bill supported by the president and the leadership of both parties went down in defeat. That just never happens.

A lot of people are wondering why the right wing of the Republican Party joined with the left wing of the Democratic Party in voting down the thievery. Forty percent of Democrats and two-thirds of Republicans voted against the bill.

Here's what happened:

The presidential race may still be close in the polls, but the Congressional races are pointing toward a landslide for the Democrats. Few dispute the prediction that the Republicans are in for a whoopin' on November 4th. Up to 30 Republican House seats could be lost in what would be a stunning repudiation of their agenda.

The Republican reps are so scared of losing their seats, when this "financial crisis" reared its head two weeks ago, they realized they had just been handed their one and only chance to separate themselves from Bush before the election, while doing something that would make them look like they were on the side of "the people."

Watching C-Span yesterday morning was one of the best comedy shows I'd seen in ages. There they were, one Republican after another who had backed the war and sunk the country into record debt, who had voted to kill every regulation that would have kept Wall Street in check -- there they were, now crying foul and standing up for the little guy! One after another, they stood at the microphone on the House floor and threw Bush under the bus, under the train (even though they had voted to kill off our nation's trains, too), heck, they would've thrown him under the rising waters of the Lower Ninth Ward if they could've conjured up another hurricane. You know how your dog acts when sprayed by a skunk? He howls and runs around trying to shake it off, rubbing and rolling himself on every piece of your carpet, trying to get rid of the stench. That's what it looked like on the Republican side of the aisle yesterday, and it was a sight to behold.

The 95 brave Dems who broke with Barney Frank and Chris Dodd were the real heroes, just like those few who stood up and voted against the war in October of 2002. Watch the remarks from yesterday of Reps. Marcy Kaptur, Sheila Jackson Lee, and Dennis Kucinich. They spoke the truth.

The Dems who voted for the giveaway did so mostly because they were scared by the threats of Wall Street, that if the rich didn't get their handout, the market would go nuts and then it's bye-bye stock-based pension and retirement funds.

And guess what? That's exactly what Wall Street did! The largest, single-day drop in the Dow in the history of the New York Stock exchange. The news anchors last night screamed it out: Americans just lost 1.2 trillion dollars in the stock market!! It's a financial Pearl Harbor! The sky is falling! Bird flu! Killer Bees!

Of course, sane people know that nobody "lost" anything yesterday, that stocks go up and down and this too shall pass because the rich will now buy low, hold, then sell off, then buy low again.

But for now, Wall Street and its propaganda arm (the networks and media it owns) will continue to try and scare the bejesus out of you. It will be harder to get a loan. Some people will lose their jobs. A weak nation of wimps won't last long under this torture. Or will we? Is this our line in the sand?

Here's my guess: The Democratic leadership in the House secretly hoped all along that this lousy bill would go down. With Bush's proposals shredded, the Dems knew they could then write their own bill that favors the average American, not the upper 10% who were hoping for another kegger of gold.

So the ball is in the Democrats' hands. The gun from Wall Street remains at their head. Before they make their next move, let me tell you what the media kept silent about while this bill was being debated:

1. The bailout bill had NO enforcement provisions for the so-called oversight group that was going to monitor Wall Street's spending of the $700 billion;

2. It had NO penalties, fines or imprisonment for any executive who might steal any of the people's money;

3. It did NOTHING to force banks and lenders to rewrite people's mortgages to avoid foreclosures -- this bill would not have stopped ONE foreclosure!;

4. It had NO teeth anywhere in the entire piece of legislation, using words like "suggested" when referring to the government being paid back for the bailout;

5. Over 200 economists wrote to Congress and said this bill might actually WORSEN the "financial crisis" and cause even MORE of a meltdown.

Put a fork in this slab of pork. It's over. Now it is time for our side to state very clearly the laws WE want passed. I will send you my proposals later today. We've bought ourselves less than 72 hours.

The Malays are wonderful people, its the politician that have created what some perceive as written in Dr Said article, not only have they divided us but they have also successfully made every policy skewered towards one race, though the truth of the matter, its benefits has always been for the members of the party ie ruling coalition ie UMNO.

I'm certain prior to the 80s, we all enjoyed great race relations in missionary schools, i remember in the primary school in La Salle, we will gear up in different costumes and dance in our annual ball, there were no racialism,only BOTAK CHIN - hero of the peasant.

Thank you Dr Said, for bringing back fond memories and to the politician, go $%#@ yrselves ha ha ha.


THE MALAYSIAN MALAY

Dear Editor,

As you know, I am an avid watcher of Malaysian affairs.

I must confess that lately, Malaysia appears to be failing.
Not a day passes by without more events that clearly highlight Malaysia 's race-religion fault-line. If things keep going this way, I fear for Malaysia 's future.

Today, schools in Singapore celebrate Racial Harmony Day. I can visibly see the joy in the children's faces as they wear their ethnic costumes and have fun together at school.
But in Malaysia - even the right to choose a religion has become a sensitive, national issue.
No doubt, there are many in Malaysia who hate my liberal views on Islam,family included.
But I will say what I must say openly. I have come to the conclusion that Malaysia cannot progress any further without first addressing fundamental questions regarding its identity and soul.

I remember the days when we can laugh at Lat's cartoons on everyday Malaysian life.
But sadly, the Islamic tide has polarised Malaysians. Some people ask why I should bother about Malaysian affairs since I ama Singaporean.
May I remind Malaysians that it was Tan Siew Sin who once said that Singapore and Malaysia are Siamese Twins.

Should Malaysia go down - it would hurt the region tremendously. Especially Singapore ..

Where do you think Malay apostates would head for if Lina Joy loses her case?
Singapore of course!

I find the Malaysian Malay to be very under-exposed.
For them, it's all Islam and the NEP and everything under the sun would sort itself out.
I am sorry to say this - but Islam and the NEP may be the cause of the undoing of the MalaysianMalay.

There is nothing wrong with religion or affirmative action.
But, like everything else in life, they must be taken in moderation and with a pinch of salt.
A little doubt is good. Unfortunately in Malaysia ,emotions over Islam have overcome reason. What we see today is the result of the NEP and Islamisation policies of the past thirty years or so.

No one owes Malaysian Malays a living.
Let me assure you that should Malaysia fail - the Malaysian Malay will suffer enormously. And rightly so. After all - they have been pampered with all sorts of goodies over the years.
They cannot now expect more goodies. Perhaps the day of reckoning for them, is near.
Whatever it is, Malaysia had better wake up to the realities around her.
The globalised world of the 21st century has no NEP to offer the Malaysian Malay.

And humans cannot live by religion alone.

I'm of the opinion, they'll always rally behind racist bigots like A. Ismail.

On bloggers, i'm certain all of us realise that they(bigots) too have thEIr cyber troopers working overtime to ensure "the fire is constantly dosed with oil" to ensure the Rakyat and nation is divided, only proven method, hit on racial lines.

The PM being the representative of BN, must take action against A Ismail and his supporters. SACK THE WHOLE LOT. Remember, the two MIC MPs were suspended sometime ago.

Anwar - Peoples Economic Policy

Anwar says aid and subsidies must be given to people in need regardless of race and that his proposals would still benefit mostly Malays who are over half the population.

Malaysia's former deputy prime minister and finance minister Anwar Ibrahim is widely respected by foreign investors for his tenure around the time of the Asian financial crisis. However, the cost of insuring Malaysian bonds against default has risen sharply since Anwar's coalition took a over a third of the seats in Malaysia's election in March, increasing political risk. The 5-year CDS stood at 140.96 basis points on Monday, up from 91.85 on March 7, the day before the election.

That means it costs almost $141,000 to insure $10 million of Malaysian bonds against default.

Here is an outline of Anwar's key economic policies, which he says are aimed at taming a budget deficit that will surge to 4.8 percent of gross domestic product this year due to a rise in government spending to 197.21 billion Malaysian ringgit ($56.88 billion):

1) Tackle what Anwar says is rampant corruption in the Barisan Nasional government. In a press conference last week, he cited the example of 3 billion Malaysian ringgit allocated to the state of Sarawak, of which he said 1 billion ringgit would be "siphoned into the pockets" of companies and individuals linked to the government thanks to special allocations in tenders to ethnic Malay companies.

2) Abandon an 11.3 billion ringgit high speed broadband link, which is too expensive. Raise cash from public tenders, all of which should be competitive and which would generate revenues of 5 billion ringgit per annum from 2009, based on 10 percent of tenders being open. All projects costed at one billion ringgit upwards would be subject to a "rigorous priority review".

All approval permits -- licenses to import cars granted to ethnic Malays (Bumiputras) for a nominal sum which they then sell on for inflated sums to others -- would be auctioned. Based on a price of 25,000 ringgit per permit, that would raise 1.75 billion ringgit on an annual 70,000 permits issued.

3) Reduce the fuel price after the government hiked it earlier this year, in an effort to cut inflation, stimulate the economy and help the country in its current economic slowdown. Anwar said 700 million ringgit in the program, which will cost 21 billion this year, had been identified by the government as waste.

4) Abandon the New Economic Policy. This policy has given ethnic Malays a range of grants, aid, loans and preferential access to higher education, the civil service, company ownership and public tenders. It was intended to offset the economic dominance of ethnic Chinese, who now make up a quarter of the population but hold about 40 percent of the wealth.

He charges the New Economic Policy has created Malay millionaires and a system of cronyism but not benefited the vast majority of ethnic Malays.

5) End equity ownership restrictions that were part of the New Economic Policy which Anwar says are "now a barrier to investment". He says moving away from equity limitations at an enterprise level will "stimulate investment and FDI (foreign direct investment)".

Eliminate tariffs and other entry barriers to negotiate free trade agreements with other ASEAN countries, Japan and the EU. Upgrade education so as to be able to compete with India, China and Singapore.

Tax rebates for exporters. Anwar says he supports lower taxes in general as a policy measure and believes that although reducing the budget deficit is important, said the developing country can run a deficit of around 3 percent of GDP

51 Yrs of Racism, Its Time To Drop It.

Malaysian have been ruled by racism the last fifty odd years, Barisan Nasional is a composition of racist and ultra left or right, its how one perceives it.

I guess Malays,Chinese, Indian, Ibans, Kadazans and all others have in the past adhere to their leaders due to the inability to read and write, majority of Malaysian were buta huruf in the 50s, 60s and 70s.

Many of the rural people depended and trusted their leaders to help them elevate from poverty and do right thing for them, we have experienced that the last 50 odd years, how they have fooled, ripped off the rakyat and kept them in line by dividing them..... the time has come for all Peace Loving Malaysians to reject racism in politics, be it Malays, Chinese, East Malaysian or Indians.

The people in power own the media and have "coloured" the minds of its readers for decades, hence, the aren't any trust between races, its a truly sad. By nature all of us are very "human" in our daily lives, we care for each others welfare. Its the media that has played the crucial part in dividing and placing mistrust among us, the editors and journalist who constantly write and remind us of our racial divide.

Here, the question is, are we going to allow them to impose racism on us? Its time all us start educating our children, sibling, neighbours and frens to reject it once and for all.

the next 4 years, we have the opportunity to once and for all kick racism out of our lives, but it begins now. recruit warriors of the people, these are individuals who propagate true values to the masses.... no religion nor race in politics.

If any of these parties do not adhere to it, we vote them out, regardless BN or PR.

STOP THE LIES, TAKE OWNERSHIP AND ASK FORGIVENESS FROM THE RAKYAT, ALL OF YOU ARE PLACED THERE TO SERVE THE PEOPLE.


NO MORE RACISM. DONT DESTROY MALAYSIA.

Cerita Lama Kot - Permainan Busuk BN ke ke

Malaysians, this is an old trick la, deploying race and religion methodology to secure and keep the Power within.... dah lapuk and busuk lol....

Well, if there's "spin" in this, its surely spun for decades, Malaysian are all familiar with it.

I've respect for PAS and am sure they'll not adhere to UMNOs tactics, UMNO will try it's best to hold on to power, too much at stake not to.

Well, for those who propogate by race and religious lines, kalau mahu sangat split Malaysia - biar yang dengki sangat kepada orang lain ie non malays set their own country, maybe Umno should do it since they always voice and comment in racial lines, i dont think Malays are racist - its this politicians who repeatedly churn it.

From where i see it, we are all caring and have respect for each other - Malays, Indians & Chinese are'nt perturbed and like one another, its this biadap politicians who are splitting us.

So, people, dont get carried away la, I've faith in PAS, beware of the spins by the "tepi jalan mentality politicians" ke ke ke

So, Is It Jail Time for Saiful???

The accuser must produce four witnesses. If the accuser fails to do so then he or she must be punished. The accused, in turn, will also have to produce four witnesses to support his or her denial or else he or she will have to face the music.

Saiful dares Anwar to swear in front of ulamaks

Mohd Saiful Bukhari Azlan has challenged PKR de facto leader Datuk Seri Anwar Ibrahim to solve the matter either through mubahalah (malediction) or take oath in front of ulamaks (religious figures). In an e-mail sent to TV3, which was aired during the station’s Buletin programme yesterday, Mohd Saiful said: “The truth will prevail. Falsehood will surely be exposed.”

The former aide to Anwar also described the sodomy issue as personal between them. Mohd Saiful said he does not blame the rakyat and hoped that they would be calm and accept the fact with an open heart.

“I take all criticisms with an open heart. As a victim, I have the right to get protection,” he said. He ended the e-mail by challenging Anwar to set the time and date to solve the matter through mubahalah. “Just inform me of the time and date. I am not afraid to keep my promise,” he added. - The Star

Now look at the following verses of the Quran.

The Quran, Surah 24: Light

1. A sura which We have sent down and which We have ordained in it have We sent down Clear Signs, in order that ye may receive admonition.

2. The woman and the man guilty of adultery or fornication,- flog each of them with a hundred stripes: Let not compassion move you in their case, in a matter prescribed by Allah, if ye believe in Allah and the Last Day: and let a party of the Believers witness their punishment.

3. Let no man guilty of adultery or fornication marry and but a woman similarly guilty, or an Unbeliever: nor let any but such a man or an Unbeliever marry such a woman: to the Believers such a thing is forbidden.

4. And those who launch a charge against chaste women, and produce not four witnesses (to support their allegations),- flog them with eighty stripes; and reject their evidence ever after: for such men are wicked transgressors;-

5. Unless they repent thereafter and mend (their conduct); for Allah is Oft- Forgiving, Most Merciful.

6. And for those who launch a charge against their spouses, and have (in support) no evidence but their own,- their solitary evidence (can be received) if they bear witness four times (with an oath) by Allah that they are solemnly telling the truth;

7. And the fifth (oath) (should be) that they solemnly invoke the curse of Allah on themselves if they tell a lie.

8. But it would avert the punishment from the wife, if she bears witness four times (with an oath) By Allah, that (her husband) is telling a lie;

9. And the fifth (oath) should be that she solemnly invokes the wrath of Allah on herself if (her accuser) is telling the truth.


So, as you can see, the Anwar-Saiful sodomy issue is actually quite easy to resolve. First of all, though, there is no such thing as carrying a Quran above your head or swearing an oath in front of people who wear turbans and robes. (If not then the Chartered Bank ‘big, strong and friendly’ jaga would not get a day’s rest). Such things do not exist in Islam and are old folks tales conjured by ignorant peasants who know no better.

The Quran has addressed this matter in surah (chapter) 9 - (Repentance, Dispensation) - verse 31. “They take their priests and their scholars to be their lords in derogation of Allah, and (they take as their Lord) Christ the son of Mary; yet they were commanded to worship but One Allah. There is no god but He. Praise and glory to Him: (Far is He) from having the partners they associate (with Him).”

You DO NOT swear an oath in front of priests or people who happen to have a better command of Arabic than you do. You swear an oath in front of God. It would be better if you can produce four witnesses to support your allegation or denial. But if you can’t, then you swear an oath four times in lieu of these four witnesses and then a fifth oath for God to condemn your soul if you are lying.

Of course, Surah Nur (Light) addresses the issue of a man who accuses a woman of adultery. But many scholars have agreed that a man accusing another man of ‘adultery’ (either with a man or woman) can be covered under these verses because adultery is adultery whatever gender is involved.

The procedure is simple. You (the accuser) produce four witnesses or you swear an oath five times that you are telling the truth. Then the accused defends himself or herself by also producing four witnesses -- or else he or she also swears an oath five times. What happens when BOTH the accuser and the accused fail to produce four witnesses and BOTH swear an oath five times? Then the next surah will apply.

The Quran, Surah 39: The Troops, Throngs

30. Truly thou wilt die (one day), and truly they (too) will die (one day).

31. In the end will ye (all), on the Day of Judgment, settle your disputes in the presence of your Lord.

32. Who, then, doth more wrong than one who utters a lie concerning Allah, and rejects the Truth when it comes to him; is there not in Hell an abode for blasphemers?

33. And he who brings the Truth and he who confirms (and supports) it - such are the men who do right.


Yes, that’s right, then the lying party gets his or her just rewards in front of God later, after he or she dies, whichever of the two may be lying. You can’t change the rules. These are the rules as laid down by the Quran. And only the Quran applies as far as the rules of conduct for Muslims are concerned.

Let us look at another scenario. A man is caught with a woman in a hotel room and this woman is not his wife. What happens? If they are both not Muslims then nothing happens. But if one or both of them are Muslims, then they will be punished. But if they are both of ‘legal’ age and it is something between two consenting adults, how can they be punished? There is no common law that declares extramarital sex as a crime. However, it is a crime as far as Islam is concerned, so if you are a Muslim then Islamic laws will apply whereby you will certainly be punished.

The same applies in other cases where Islam regards such conduct as a crime. In an allegation of adultery, Islam is very specific as to how one must face the music. The accuser must produce four witnesses. If the accuser fails to do so then he or she must be punished. But if the accuser swears an oath five times, then he or she will escape punishment and will have to face God later to be punished if he or she is lying.

The accused, in turn, will also have to produce four witnesses to support his or her denial or else he or she will have to face the music. And if the accused also swears an oath five times, then he or she will escape punishment but will have to face God later to be punished if he or she is lying.

Okay, you might argue that since sodomy is a crime under Malaysia’s common law then common law and not Islamic law must apply. Is that so? In that case I can’t be punished for not praying five times a day or for not going to the mosque on Friday since these are not crimes under common law. I can also drink beer in public and eat and drink in the daylight hours during the month of Ramadhan since these are also not crimes under common law. I can also have sex with a woman who is not my wife since this too is not a crime under common law -- as long as she is not 15 years old.

How can I be punished for all these ‘crimes’ when common law does not make them crimes? So you see, common law cannot override the Quran whenever the Quran specifies the conduct of Muslims as well as the punishment for breaching this code of conduct. If you are a Muslim, then the Quran applies, not common law. Common law only applies whenever the Quran is silent on any issue.

In fact, oral sex is a crime under common law and you can be jailed up to a maximum of seven years if you commit this ‘crime’. But Islam does not declare oral sex a crime so Muslims are permitted to enjoy oral sex although under common law they can be sent to jail for a long time. The religious scholars are divided on the matter of anal sex and some scholars say it is permitted while others say it is not. But under common law you can be sent to jail just like in the case of oral sex. Muslims, however, are allowed to follow their scholars’ advice in either doing it or not doing it, as the case may be, and they do not care what common law has to say about it.

Yes, where the Quran is specific about something then Islamic laws will apply. Only when the Quran is silent about the subject matter will common law apply (like parking your car in a ‘no parking’ zone). There is also no sedition in Islam. In fact, the Sedition Act is un-Islamic. Islam makes it mandatory to speak out against the government and rulers and it would be a sin to keep quiet. So do not fear going to jail for a ‘crime’ of sedition because God will punish you more severely later if you keep silent for fear of going to jail when it is mandatory to speak out against transgressions and to oppose oppression. Two years jail is nothing compared to what God will do to you later.

So, back to the sodomy issue; Saiful has to swear an oath five times and so does Anwar. And if they do that then the matter ends there, at least as far as this life is concerned. Then one of them, the lying party, will have to face God later to receive his punishment. This is what God says and since both are Muslims then this, and only this, will be what will apply. Man’s laws cannot override God’s laws when you are a Muslim. That is the long and short of the whole issue

The Law on SDs;The Grave can Speak ke ke

“…where a witness is dead, it may be better to admit evidence of what he said than to deprive the court of all proof” - Phipson on Evidence.

That’s a text book commentary on the English common law position in the matter of what is commonly referred to as the ‘dying declaration’ exception to the hearsay rule.

In our jurisdiction, that exception is encapsulated in section 32(1)(a) of the Evidence Act, 1950, which reads :

(1) Statements, written or verbal, of relevant facts made by a person who is dead or who cannot be found, or who has become incapable of giving evidence, or whose attendance cannot be procured without an amount of delay or expense which under the circumstances of the case appears to the court unreasonable, are themselves relevant facts in the following cases:

(a) when the statement is made by a person as to the cause of his death, or as to any of the circumstances of the transaction which resulted in his death, in cases in which the cause of that person’s death comes into question.

In 1939, the Privy Council heard an appeal from India which involved a consideration of the Indian equivalent of our section 32(1)(a). This is the case of Pakala Narayana Swami v. King-Emperor. I will not burden you with the facts of the case, which was one of homicide, but just reproduce below what Lord Atkins said in relation to the Indian equivalent to our section 32(1)(a) :

‘…The statement may be made before the cause of death has arisen, or before the deceased has any reason to expect to be killed. The circumstances must be circumstances of the transaction. General expressions indicating fear or suspicion, whether of a particular individual or otherwise, and not directly related to the occasion of the death, will not be admissible. However, statements made by the deceased that he was proceeding to the spot where he was in fact killed or as to his reasons for so proceeding, or that he was going to meet a particular person, or that he had been invited by such person to meet him, would each of them be circumstances of the transaction, and would be so whether the person was unknown, or was not the person accused. Such a statement might indeed be exculpatory of the person accused. “Circumstances of the transaction” is a phrase, no doubt, that conveys some limitations. It is not as broad as the analogous use in “circumstantial evidence”, which includes evidence of all relevant facts.

Such a statement is relevant whether the person who made it was or was not at the time when it was made under expectation of death, and whatever may be the nature of the proceeding in which the cause of his death comes into question’

That’s a lot to absorb, I know, but what might all this mean in the context of Bala’s first SD?

Read paragraphs 26 to 31 inclusive. These narrate a conversation between Bala and Altantuya on the night of 19th October, 2006. If this conversation did in fact take place, it may well be the last conversation that Altantuya had before her death that we may ever know about.

Are the contents of all of paragraph 28 hearsay?

I think so.?

Might they come within the exception permitted by section 32(1)(a)?

A court of law must decide that question.
